Your Voice Needed NOW on Coastal Open Space, Building Heights
This Tuesday, 4/8/08 at 10 a.m., (arrive at 9) the Charlotte County Commission will vote to:
- LOWER COASTAL OPEN SPACE from 20% in Planned Developments (PD's) to
JUST 10% - with half of that allowed INSIDE !
- RAISE THE BUILDING HEIGHTS in our Coastal High Hazard areas from 35 feet to 65 FEET.
- LOWER PD Standards for Setbacks and Buffers to ZERO, and more.. (see attached)
- LEAVES FINAL DECISIONS in the hands of Staff (see p. 11, line 18 of the proposed ordinance on florida.sierraclub.org/charlotteharbor under "action") See the attached PROBLEMS/SOLUTIONS sheet with BETTER IDEAS. Gutting our standards in the Coastal High Hazard Area could lead to increased density, evacuation problems and loss of wildlife habitat.
Yet - the Building Industry is Propagandizing these changes and will show in force. Please:

Our local Florida Legislators are supporting bills NOW BEING CONSIDERED in the House and Senate which would preempt the ability of local governments to protect us, their citizens, from the impacts of mining activities. This is despite the fact that the Legislature-convened Strategic Aggregate Task Force found that the facts do not support the claim that there is an aggregate unavailability crisis, and FDOT could not identify a projected deficit of the material. At least one of our legislators admitted on 4/5/08 to not having read the Task Force Recommendations. Ignoring these findings, these bills would:
· Preempt local government's ability carry out requirements of their comprehensive plans, such as protecting schools, residential areas, wetlands, water bodies, and lands set aside for preservation from the adverse impacts of mining activities.
· Prevent local governments from enacting stronger land use restrictions than the state in order to protect natural resources in their jurisdictions
*** At least one of the bills would retroactively remove the protections put in place by Charlotte County in 2007 in our new excavating and earthmoving ordinance and our new zoning category for mining. The protections we would lose include: water monitoring requirements, cumulative impact measurements, listed species surveys and more. In addition, the bills would remove Lee County's ability to create stronger protections for residents and wildlife inside the DRGR, which has been the subject of a years-long study.
Email our Legislators (below) to 1) Review the Consensus Recommendations adopted by the Task Force and presented to the Legislature in February, 2008, and to 2) Work to Stop - and Vote Against - any legislation which involves preemption of local authorities' abilities to protect their citizens from the impacts of mining activities. Examples are: Senate Bill 2406, House Bill 774 and ENRC13. Include your name and town if possible.
